Terms and Conditions

1. Acceptance of Terms

Accessing or using the Service, whether by you directly or by your organization, constitutes full acceptance of these Terms. If you do not agree with any provision, you must not use the Service.

If you accept these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case “you” refers to that entity.

2. Description of the Service

FlowPOS provides point-of-sale functionality, electronic invoicing (FEL), inventory control, cash register management, sales reporting, and customer communication tools, among others, aimed at restaurant and retail businesses.

We reserve the right to modify, add, or remove features of the Service at any time, in order to improve its performance, security, or regulatory compliance.

3. User Accounts and Eligibility

To use the Service you must create an account and provide truthful, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your access credentials and for all activity that occurs under your account.

You must notify us immediately of any unauthorized use of your account or any other security breach you become aware of.

4. Subscriptions, Pricing, and Billing

Access to the Service is subject to the subscription plans currently published at flowpos.gt/pricing. Prices may be denominated in Guatemalan Quetzales (GTQ) and may be adjusted with reasonable prior notice.

Certain features, including SMS and WhatsApp notifications, may be subject to additional usage-based costs, which will be billed according to the contracted plan.

5. Acceptable Use

You agree to use the Service in accordance with applicable law and not to use it for fraudulent or illegal purposes, or in a way that infringes the rights of third parties.

You may not attempt to compromise the security of the Service, reverse-engineer the software, or use the Service to send unsolicited communications (spam) to third parties.

6. SMS, WhatsApp, and Email Communications

The Service allows the businesses that use it (“Merchants”) to send transactional notifications to their own customers and staff — such as invoice payment links, platform invitations, cash register closing summaries, and credit/debit note notices — via SMS, WhatsApp, and email.

These communications are transactional and informational in nature, not promotional. Recipients may request to stop receiving messages at any time by contacting the relevant Merchant directly. Message and data rates may apply depending on the recipient's carrier.

Merchants are responsible for having a lawful basis to communicate with their own customers and for complying with data protection and commercial communications regulations applicable in their jurisdiction.

7. Intellectual Property

The Service, including its software, design, trademarks, and content, is owned by FlowPOS or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service, only a limited, non-exclusive, non-transferable license to use it as set out herein.

8. Privacy and Data Protection

Processing of personal data through the Service is governed by our privacy practices, available upon request. Merchants are responsible for the processing of their own customers' personal data entered into the Service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, FlowPOS shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Service.

10. Termination

We may suspend or terminate your access to the Service in the event of a breach of these Terms, non-payment of subscription fees, or as required by law. You may cancel your subscription at any time in accordance with your plan's terms.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the Service or via your registered contact channels. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Guatemala. Any dispute arising from these Terms shall be submitted to the competent courts of Guatemala, unless applicable law provides otherwise.
